DARLING – Yacht Charter Terms & Conditions
These Terms & Conditions apply to all bookings and charters of the yacht DARLING (Azimut 62 Evo) operated by the Charter Company.
1. Booking & Payment
A booking is confirmed only after receipt of the agreed deposit. The remaining balance must be paid before embarkation unless otherwise agreed in writing.
2. Security Deposit
The Charter Company reserves the right to request a refundable security deposit to cover any loss, damage, excessive cleaning, or breach of these Terms & Conditions.
3. Charter Duration
The charter period begins and ends at the times specified in the booking confirmation. Delays caused by the Charterer or guests do not extend the charter period.
4. Captain & Crew Authority
The yacht is operated exclusively by the appointed captain and crew. The captain has full authority regarding navigation, safety, weather conditions, guest conduct, and itinerary adjustments.
5. Weather & Safety
The captain may modify routes, destinations, departure times, or cancel a charter if weather or sea conditions are considered unsafe. Such decisions are final and made solely for safety reasons.
6. Guest Responsibilities
Guests must follow all safety instructions, respect the yacht and equipment, avoid unlawful or dangerous behavior, and supervise children at all times. The Charterer is responsible for the conduct of all guests onboard.
7. Damage & Liability
The Charterer is liable for any damage caused by guests through negligence, misuse, or intentional acts. The Charter Company shall not be liable for loss, theft, damage to personal belongings, injury,
delay, weather conditions, or events beyond its reasonable control.
8. Smoking, Pets & Illegal Substances
Smoking is permitted only in designated outdoor areas. Illegal drugs, weapons, and hazardous materials are strictly prohibited onboard. Pets are permitted only with prior written approval.
9. Cancellation Policy
More than 30 days before charter: deposit refundable, less administrative fees. 15–30 days before charter: 50% of total charter fee payable. Less than 15 days before charter or no-show: 100% of total charter fee payable.
10. Force Majeure
The Charter Company shall not be liable for cancellations, delays, or changes resulting from weather, government restrictions, natural events, technical failures, strikes, or other circumstances beyond its reasonable control.
11. Governing Law
These Terms & Conditions shall be governed by the laws of the Republic of Bulgaria. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Bulgaria.
By confirming a booking, the Charterer acknowledges and accepts these Terms & Conditions on behalf of all guests onboard.
